GO-NH 2007Legislation List

The updates on the status of legislation as of August 1, 2007. Included are bill summaries and the GO-NH position on the bills. To see the text and final status of a bill, click on the bill number.

HB685
prohibiting New Hampshire from participating in a national identification card system.
SUPPORT
General Court LogoProhibiting New Hampshire from participating in a national identification card system, and establishing a death benefit to be paid to the family of a police officer or firefighter killed in the line of duty and establishing a committee to study the eligibility for and award of the benefit.

SPONSORS: Rep. Kurk, Rep. Phinizy, Rep. Winters, Rep. L. Christiansen, Rep. Almy, Sen. Burling

GO-NH Logo Passed and signed into law. Please contact the sponsors and thank them for putting this bill in. Then, call, write or e-mail your own state representatives and senator and the governor to thank them.
HB707
relative to the time frames for hearings in domestic violence cases.
OPPOSE
General Court LogoThis bill permits the court to extend the hearing date in a domestic violence case for good cause. The bill also addresses the standard for granting visitation in a temporary order and the standard for dismissal based on delay of hearing.

SPONSORS: Rep. Knowles, Rep. Tholl, Rep. Charron, Sen. Gottesman, Sen. Estabrook, Sen. Kenney

GO-NH LogoPassed, with an amendment that makes it more palatable, and signed into law.
HB760
relative to temporary relief in a domestic violence proceeding.
SUPPORT
General Court LogoThis bill requires the plaintiff to testify at the hearing for temporary relief in a domestic violence proceeding, for the hearing to be on the record, and for a record of the testimony to be made available to either party.

SPONSORS: Rep. Dumaine

GO-NH LogoUnfortunately, this bill was found INEXPEDIENT TO LEGISLATE. Requiring the plaintif to testify after a domestic abuse charge is fair and more in keeping with the spirit of the law in this country, and so is requiring the testimony to be recorded and made available to all parties. Because domestic violence is an awful thing, complaints are too often rubber-stamped, and this bill would have gone a long way toward stopping that.

HB906
relative to an informed jury.
SUPPORT
General Court Logo The bill stated that in all criminal proceedings the court would instruct the jury of its inherent right to disregard the law and the facts in controversy and to nullify any and all actions they find to be unjust. The court would also have been required to allow the defendant or counsel for the defendant to explain this right of jury nullification to the jury.

SPONSORS: Rep. Ingbretson, Rep. DiFruscia, Rep. Sorg

GO-NH LogoMost unfortunatelly, this bill was found INEXPEDIENT TO LEGISLATE. This bill was one of the most important bills before the legislature this or any other year, because it confirmed the right of the people established when this country was founded. Hopefully, the sponsors of this bill, along with other freedom-minded legislators, will propose this again and get it passed.

HB909
relative to the oaths required of public officers
WATCH
General Court Logo This bill provides that either the governor and council or the legislature may dismiss a public officer who violates his or her oath of office.

SPONSORS: Rep. Itse, Rep. L. Christiansen

GO-NH LogoFound INEXPEDIENT TO LEGISLATE.
SB44
relative to licenses to carry pistols and revolvers..
OPPOSE
General Court Logo This bill permits an official authorized to issue licenses to carry pistols and revolvers to deny a license to any person the official reasonably believes to be a member of a terrorist or criminal organization. The bill also prohibits the award of attorney’s fees and costs personally against an employee or official of a licensing entity.

SPONSORS: Sen. Burling, Rep. Hammond, Rep. Tholl

GO-NH Logo This all-around bad bill was, happily, found INEXPEDIENT TO LEGISLATE, thanks in great part to an overwhelming number (an estimated 600 or more) of our members and supporters showing up for the hearing. Thank you!
